HIPAA Exemption
You acknowledge and agree that Prodigy Healing is not a “covered entity” under HIPAA, and therefore, HIPAA privacy regulations do not apply to any information you share. Although discretion and privacy are honored, the protections of HIPAA do not govern these services.
Confidentiality
All information shared during sessions is treated with discretion and will not be disclosed to third parties without your consent, unless required by law.
You understand that certain observations or impressions may reference third parties. Such references do not constitute a breach of confidentiality so long as personally identifiable information is not disclosed to others.
Use of Anonymized Information
You agree that anonymized and aggregated information derived from your session may be used internally for educational, research, or quality improvement purposes. Identifying information shall be removed unless explicit written permission is granted.
Refund Policy
Cancellations made 24 hours or more in advance are eligible for a full refund. Sessions canceled with less than 24 hours’ notice, or missed without notice, may be non-refundable and may be subject to a $35 cancellation fee.
No refunds are issued for services that have already been rendered, regardless of client satisfaction or perceived results.
Additionally, there are no refunds for gift cards or for multi-session packages that have already been partially or fully used. All such purchases are considered final once redemption has begun.
Payment for Time and Attention
By booking any session, you agree that payment is made in exchange for the practitioner’s time, presence, and attention — not for a specific result or guaranteed outcome.
Once a session has occurred, the agreed-upon time has been fulfilled. No refunds will be granted on the basis of personal dissatisfaction, perceived ineffectiveness, or disagreement with the content presented.
Client Responsibility
You acknowledge that you are solely responsible for your own well-being, decisions, and actions before, during, and after any session. Prodigy Life LLC does not guarantee results, and outcomes may vary depending on individual circumstances, readiness, actions, and engagement.
Communication Boundaries
Prodigy Life LLC reserves the right to determine appropriate methods and timing of communication. E-mail is the preferred mode of contact, and replies may not be immediate. Phone calls, text messages, or communication via third parties may not be accepted without prior arrangement.
Right to Refuse Service
Prodigy Life LLC reserves the right to decline or discontinue services to any individual, at its sole discretion and without obligation to provide explanation, particularly in cases of harassment, abusive behavior, or conduct inconsistent with these Terms & Conditions.
Intellectual Property
All materials, methods, and content provided by Prodigy Life LLC — whether written, verbal, visual, or conceptual — are the intellectual property of Prodigy Life LLC and may not be copied, distributed, published, or used commercially without express written consent.
This includes session content, terminology, methodologies, diagrams, digital assets, and teaching frameworks.
No Third-Party Beneficiaries
These Terms & Conditions are established solely between you and Prodigy Life LLC. No third party shall have any right to enforce or benefit from these terms or bring claims based upon them.
Electronic Acceptance
By checking a box, submitting a form, scheduling a session, or otherwise affirming agreement electronically, you acknowledge that such action constitutes a legally binding acceptance equivalent to a physical signature.
Limitation of Liability and Time to Bring Claims
To the maximum extent allowed by law, any and all liability of Prodigy Life LLC, its affiliates, or representatives shall be strictly limited to the total amount you paid for services within the ninety (90) days prior to the claim.
Furthermore, any claim or cause of action must be initiated within ninety (90) days of the event giving rise to the claim, or it shall be permanently barred.
Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of the Commonwealth of Virginia. You agree to submit to the exclusive jurisdiction of the state and federal courts located in the Commonwealth of Virginia, and waive any objection to such venue.
Binding Arbitration Clause
Any dispute, claim, or controversy arising out of or relating to your use of Prodigy Life LLC’s services shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Arbitration shall take place in Fairfax County, Virginia.
- The arbitrator shall have exclusive authority to resolve all disputes, including issues regarding enforceability.
- You waive the right to trial by jury and any right to participate in a class action or class arbitration.
